I would certainly hope that no judge anywhere could misconstrue "waiting to learn X" as "I am telling you X is a known fact", but with the bad trajectory these days...

That said, AFAICT at least some of those patents existed long ago and expired. So I would guess the insider-trading money would be on either be shorting companies involved in current MMR vaccines, or else something a bit more indirect.
