Without a physical human operating the camera, at the site, yes, it should not be allowed.

This is actually the distinction in many EU countries, i.e. it’s allowed to record a movie if the operator is present, but doing the same thing remotely requires permission from a special authority/agency (that’s not in cahoots with the police).
