Why can't we use it in the US then?

It doesn’t matter if the user is in the U.S. or not. The export license (the mechanism used by the government) treats foreign nationals in the U.S. just like foreigners outside. For the same reason if you look at even slightly sensitive industries, there will be teams that are exclusive to U.S. citizens.
