Yes, lots of danger here. If you "hack back" and disable a residential router used as a proxy by some evil cyber criminal, are you liable for damages? It could get worse from there, easily. What if you hack back and fuck up some APT that turns out to be the NSA? Could be bad on a national level. Smart folks won't take this bet, which means dumb ones will, making the problems worse.
